What is Sole Custody
One parent is awarded custody of the child and the full and complete power to make all decisions concerning the child. Typically happens when the other parent is in prison; addicted to narcotics; or the other parent is absent and has no contact with the child.
What is Joint Custody
This is when the legal custody of the child is granted to both parents jointly. Neither parent has legal custodial rights superior to those of the other parent. An award of joint custody does not necessarily mean that the child must spend equal time with or live with both parents. This is common

This is when the legal custody of the child is given to both parents as joint legal custodians. This means the parties share the parenting time. Neither parent has physical care rights superior to the other parent. You need to be getting along with your ex. for this to work.
How is child support calculated?
Child support is based on many factors. The income of each party. The costs of health insurance; union dues; child care expenses, etc. Iowa follows “Guidelines” so that support is calculated as fairly as possible.
Can my spouse and I use the same lawyer?
No. This is not proper nor ethical. The party who hires the lawyer will have an advantage. Seek advice. Many lawyers will provide a free, initial consultaiton. Once a decree is entered, it is very difficult to get anything changed.
Can we just agree on a child support amount?
Yes, but the amount must be in accordance with Iowa’s Child Support Guidelines. Judges must approve any amount you may agree to and if the number is not in accordance with the Guidelines, it won’t be approved.

Can't the judge help me with this?
No. Judges are bound by ethical rules of conduct and are not allowed to give advice. Judges decide cases based on the information provided by the parties. They cannot help you prepare the paperwork you will need to obtain a divorce. They cannot calculate the child support for you.
